The Mediation CMFM entity is listed as a consumer mediator by a decision of the CECMC (Commission for the Evaluation and Control of Consumer Mediation) dated June 30, 2017.
CMFM Mediation will intervene for the amicable handling of disputes between the consumer customer and the DS AUTOMOBILES Brand.
In the event of a dispute between the parties, falling within the responsibility of the Manufacturer (example: quality of the product or services), they will endeavor to resolve it amicably.
In the absence of an amicable agreement, the consumer customer is informed in accordance with article L.211-3 of the Consumer Code only before possibly referring the matter to the competent legal courts and following a written complaint to the Relations DS customers whose address appears under the “Contact us” tab, they have the possibility of contacting, free of charge, a mediator registered on the list of mediators established by the Commission for the Evaluation and Control of Consumer Mediation in application of article L.615-1 of the Consumer Code, as follows:
The consumer client remains free to accept or refuse recourse to mediation and, in the event of recourse to mediation, each party is free to accept or refuse the solution proposed by the mediator.
In the absence of an amicable agreement, recourse to mediation or acceptance by the parties of the solution proposed by the mediator, the dispute between a consumer customer and the DS AUTOMOBILES brand will be brought before the court according to the rules of common law. .
In the event of a dispute between the DS AUTOMOBILES brand and a commercial customer that is not resolved amicably, referral to a mediator will not be possible and only the courts on which their head office depends will have jurisdiction. This new procedure results from the transposition, since January 1, 2016, of the European directive relating to the extrajudicial resolution of consumer disputes which requires the professional to offer its consumer clients a free mediation procedure accessible by mail or online on the internet.
